Djuce Wines cares about privacy and is committed to protecting your privacy and the personal data handled by us. All personal data is processed in accordance with applicable law, including the German General Data Protection Regulation (DSGVO) and the Federal Data Protection Act. In this Policy we describe how and the purposes for which we use your personal information as well as what lawful basis we use and what measures we take to protect Personal data. We also provide information on how you exercise the rights you have linked to our Processing of Personal data.

Djuce Wines respects and is committed to protecting your privacy. This Privacy Notice describes the types of information we may collect from you when you visit https://www.djucewines.com or other Djuce Wines websites or use our mobile applications (collectively, the “Site”), how we use the information we collect, with whom we share it, how we protect it, and the choices we offer you regarding our collection and use of such information. The intended recipient of the information provided in this Policy is:

Why and Who

Djuce Wines GmbH ("Djuce Wines", "we", "us", "our") is the Controller of all Personal Data listed in this Privacy Policy (the "Policy"). In order to be fully transparent regarding where your Personal Data is stored and Processed, we will also provide a list of all our data Processors. This Policy provides information on how we handle Personal Data when you communicate with us or visit our website https://www.djucewines.com (together the “Functions").

Definitions

"Applicable Law" refers to the legislation applicable to the processing of Personal Data, including the GDPR, supplementary national legislation, as well as practices, guidelines and recommendations issued by a national or EU supervisory authority.
"Controller" is the company/organisation that decides for what purposes and in what way personal data is to be processed and is responsible for the Processing of Personal Data in accordance with Applicable Law.
"Data Subject" is the living, natural person whose Personal Data is being processed.
"Personal Data" is all information relating, directly or indirectly, to an identifiable natural person.
"Processing" means any operation or set of operations which is performed on Personal data, e.g. storage, modification, reading, handover and similar.
"Processor" is the company/organisation that processes personal data on behalf of the Controller and can therefore only process the Personal Data according to the instructions of the Controller and the Applicable Law.
The definitions above shall apply in the Policy regardless if they are capitalised or not.

Djuce Wines's role as a Controller

The information in this Policy covers Personal Data Processing for which Djuce Wines is the Controller. As a Controller we are responsible for the Processing for which we decide the purpose of ("the why") and the means for the Processing (what methods, what personal data and for how long it is stored). The Policy does not describe how we Process Personal Data in the role of a Processor - i.e. when we process Personal Data on behalf of our customers.

Lawful basis

Consent - Djuce Wines may process your personal data after you have given your consent to the Processing. Information regarding the processing is always provided in connection to the request of consent.
Performance of a contract - The Processing is necessary for the performance of a contract entered between us and the Data Subject, or to prepare for entering into an agreement with the Data Subject.
Legitimate interest - Djuce Wines may process Personal Data if we have assessed that a legitimate interest overrides the interest of fundamental rights and freedoms of the Data Subject, and if the processing is necessary for the purpose in question.
Legal obligation - We are required by laws and regulations to process Personal Data as a result of our business.

For how long do we store your personal data?

We will keep your personal data as long as it is necessary for the purpose for which it was collected. Depending on the lawful basis on which we support the Processing, this may a) be regulated in a contract, b) be dependent on valid consent, c) be stated in legislation or d) follow by an internal assessment based on a legitimate interest assessment (LIA). In the list below, we indicate, where possible, the period during which the Personal Data will be stored and the criteria used to determine the storage period.

We have a responsibility to describe and demonstrate how we fulfill the requirements that are imposed on us when we Process your Personal Data. This section aims to describe:

Information We Collect and How We Use It

We may collect personal information from you, meaning information about you that can uniquely identify you, as well as non-identifying information, if you choose to provide us with such information. For example, if you register as a Djuce Wines member we may collect your email address, telephone number, city of residence, zip code, wine and taste preferences, and other information. Additionally, when you access the Site using a mobile device, we may collect and process real-time information about the location of your device if you consent to allow us to do so. We may also collect information indirectly from you through your use of the Site. For more information, see the “Cookies” section, below.

We may use the information/ personal data we collect to:

We may enable you to sign into the Site via social networks or access social networks through the Site. If you do so, your use of the social network is governed by such social network’s terms and conditions and privacy policies. If you sign into the Site via a social network or access a social network through the Site, you may be asked to grant Djuce Wines access to certain information from your social network profile. We may use this information to help you personalize your experience with the Site, to suggest new features and content that may be relevant to you, or for statistical or other business purposes. We also may use the information we obtain about you in other ways for which we provide specific notice at the time of collection. We may enable third parties to collect information in connection with our Site. This Privacy Notice does not apply to, and we are not responsible for, any collection of information by third parties on our Site.

Cookies

When you visit the Site, we may also collect certain information by automated means to give you the best user experience, such as through the use of cookies. A “cookie” is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. We are using cookies in many different shapes. We are using cookies for technical and functional reasons as well as marketing and analysis; essential cookies, preference cookies, marketing cookies as well as statistics cookies. We use cookies to store members’ preferences and record certain information to alert members to new information that we think may be of interest to them when they return to our Site, and customize web page content based on a member’s browser type or other information we collect. We also may use third-party website analytics tools (such as Google Analytics), that collect information about user traffic on the Site. The data is stored between one day and up to two years (of course as long as we have consent from you) and can also be session-based. The information we collect by automated means may include, but is not limited to, the following:

  • information about the devices you use to access the Internet (such as the IP address and the type of the device, operating system, and web browser);
  • Session information e.g. dates, times, and duration of visits to the Site (including whether you are a registered member or first time visitor); and

How We Respond to Do Not Track Signals

Your web browser may let you choose your preference as to whether you want to allow websites to collect personal information over time about your online activities across different websites or online services. At this time our Site does not respond to the preferences you may have set in your web browser regarding the collection of your information, and our Site may continue to collect information in the manner described in this Privacy Notice.

Information We Share

We may disclose aggregated or anonymized information about our users without restriction. We may disclose your personal information:

  • to our contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep such personal information confidential and use it only for the purposes for which we disclose it to them;
  • to third parties to market their products and services to you if you have not opted out of these disclosures;
  • to comply with court orders, laws, or legal process, including to respond to government or regulatory requests;
  • to enforce or apply our Terms & Conditions and other agreements;
  • if we believe disclosure is necessary or appropriate to protect our or others’ rights, property, or safety; and/or

We may also disclose your personal information to a buyer or other transferee in the event of a merger, divestiture, restructuring, reorganization, dissolution, sale, or other transfer of some or all of our assets. Should such a sale, merger, or transfer occur, we will use reasonable efforts to direct the transferee to use your personal information in a manner that is consistent with our Privacy Notice.

Personal data being processed: name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number). version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site. Instructions: We share your Personal Information with Recharge to help us provide our services and fulfill our contracts with you.
  • Processor: Yotpo. Personal data being processed: name, version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site. Instructions: We share your Personal Information with Yotpo to help us provide our services and fulfill our contracts with you.

Changes to our Privacy Notice

From time to time, Djuce Wines may update this Privacy Notice. If our information practices materially change at some time in the future, we will post the policy changes to our Site to notify you of these changes, and we will only use data collected from the time of the policy change forward for these new or different purposes. In the event we make a material change to how we use your personal information, we will provide you with an opportunity to opt out of such new or different use. The date this Privacy Notice was last revised is at the top of this page. You are responsible for periodically reviewing the Site and this Privacy Notice to check for any updates or changes.

Your Choices

You may choose how Djuce Wines contacts you and how Djuce Wines collects and uses your information in the following ways:

  • Marketing Emails. Individuals who have elected to receive Djuce Wines’ informational emails, including newsletters about wine deals, can choose to opt-out at any time by clicking on the "Unsubscribe" link at the bottom of each email. Djuce Wines Members can also opt out from newsletters by logging into the Site and visiting the Account section.
  • Cookies. Most browsers will tell you how to stop accepting new cookies, how to be notified when you receive a new cookie, and how to disable existing cookies. Please note, however, that without cookies you may not be able to take full advantage of all of the Site’s features.

Your rights

You are the one in control of your Personal data and we always strive to ensure that you can exercise your rights as efficiently and smoothly as possible.

  • Access - You always have the right to receive information about the Processing of data that concerns you. We only provide information if we have been able to verify that it is you that are requesting the information.
  • Rectification - If you find that the Personal Data we process about you is incorrect, let us know and we will fix it!
  • Erasure - Do you want us to completely forget about you? You have the right to be forgotten and request deletion of your Personal Data when the Processing is no longer necessary for the purpose for which it was collected. If we are required to retain your information under applicable law or a contract that we have entered with you, we will ensure that it is processed only for the specific purpose set forth in such applicable law or contract. We will thereafter erase the information as soon as possible.
  • Objections - Do you disagree with our assessment that a legitimate interest for Processing your Personal Data overrides your interest in protecting your privacy? Don’t worry - in such case, we will review our legitimate interest assessment. Of course, we add your objection to the balance and make a new assessment to see if we can still justify our Processing of your Personal Data. If you object to direct marketing, we will immediately delete your personal information without making an assessment.
  • Restriction - You can also ask us to restrict our Processing of your Personal Data
    • Whilst we are Processing a request from you for any of your other rights;
    • If, instead of requesting erasure, you want us to limit the Processing of Personal Data for a specific purpose. For example, if you do not want us to send advertising to you in the future, we still need to save your name in order to know that we should not contact you; or
    • In cases where we no longer need the information in relation to the purpose for which it was collected, provided that you do not have an interest in retaining it to make a legal claim.
  • Data portability - We may provide you with the data that you have submitted to us or that we have received from you in connection with a contract that we have entered with you. You will receive your information in a commonly used and machine-readable format that you can transfer to another personal data manager.
  • Withdraw consent - If you have given consent to one or several specific processing(s) of your Personal Data, you have the right to withdraw your consent at any time and thus ask us to terminate the Processing immediately. Please note that you can only withdraw your consent for future processing of Personal Data and not for Processing that has already taken place.

Transfer of personal data

In order to run our business, we may need help from others who will process Personal Data on our behalf, so-called Processors.
In cases where our Processors transfer Personal Data outside the EU/EEA, we have ensured that the level of protection is adequate, and in compliance with Applicable Law, by controlling that either of the following requirements are fulfilled:
the EU Commission has determined that the level of protection is adequate in the third country where the data is processed;
the Processor has signed up to the EU Commission's standard contract clauses (SCCs) for data transfer to non-EU/EEA countries; or
the Processor has taken other appropriate safeguards prior to the transfer and that such safeguards comply with Applicable law.
We have entered into Data Processing Agreements (DPA) with all our Processors. The DPA sets out, among other things, how the Processor may process the Personal Data and what security measures are required for the Processing.
We may also need to disclose your personal information to certain designated authorities in order to fulfill obligations under applicable law or legally binding judgements.

Security

We have implemented technical and organisational security measures that are designed to protect personal information from accidental loss, disclosure, misuse, and destruction. Please be aware, however, that no data security measures can be guaranteed to be completely effective. Consequently, we cannot ensure or warrant the security of any information that you provide to us. You transmit information to us at your own risk.

Our security measures

Organisational security measures are measures that are implemented in work methods and routines within the organisation including internal governance documents (policies/instructions), login and password management and information security policy. Technical security measures are measures implemented through technical solutions and includes secure network and two-step verification.

Collection of Children’s Information

The Site is not directed to, and we do not knowingly collect or solicit personal information from, anyone under the legal age of marketing of alcoholic goods in your country of residence. If we learn we have collected or received personal information from anyone under said legal age, we will delete that information. If you believe we might have any information from or about anyone under said legal age, please contact us.

If you think that we are not Processing your Personal Data correctly, even after you have notified us of this, you are always entitled to submit your complaint to the German Authority for Privacy Protection via your state’s competent supervisory authority.
